Gao Dekang, chairman of the Board of Bosideng International Holdings Ltd and a deputy to the National People’s Congress (NPC), submitted a proposal calling for stronger protection of intellectual property rights on e-commerce platforms and putting forward multiple suggestions on the ongoing legislation of E-commerce Law.

The e-commerce industry which has achieved a resounding triumph in 2013 is now becoming a rising star among all economic sectors. However, behind the facade of a booming market, some undesirable phenomena emerge. Recent years have seen an increasingly amount of counterfeit and inferior products and trademark infringements in the e-commerce market to the prejudice of the rights and interests of both well-known enterprises and customers.

“We hope that e-commerce platforms will conduct a stricter review over materials concerning intellectual property rights,” said Gao.

IPR cases accounts for the largest share among the present e-commerce disputes. And the most typical ones usually involve a usurpation of pictures, texts and videos of well-known enterprises, seriously misleading the customers, introduced Gao. Due to legislative lag and deficiency in governing laws, people’s courts at different levels often reach contradicting judgments on cases involving IPR infringements by e-commerce services. Deputy Gao then further suggested that the Supreme People’s Court lay down an universal judgment standard for such cases.
