The Office of Legislative Affairs of Jiangsu provincial government released The Exposure Draft for Jiangsu Patriotic Sanitary Regulations (Draft) (hereinafter referred to as the Draft) on Feb 19, which specially introduces the “control over the hazards tobacco smoke” in one chapter.
The Draft stipulates that smoking is banned in indoor public places, public transport vehicles and other public areas classified by the local people’s governments above the county level (hereinafter referred to as no-smoking places). The units that exercise jurisdiction over these no-smoking places should give clear non-smoking warnings and signs and arrange full-time (part-time) personnel to discourage the smokers from smoking. In outdoor public places where the smoking area is set, the smoking areas mustn’t be set in pedestrian path. The units that exercise jurisdiction over these outdoor no-smoking public places should give clear warnings and publicity signs for smoking control, such as “Smoking is harmful to health”.
If the units that exercise jurisdiction over no-smoking places fail to give non-smoking warnings or signs, or if the units that exercise jurisdiction over outdoor no-smoking places fail to give clear signs and publicity signs for smoking control such as ”Smoking is harmful to health”, the relevant authorities stipulated by the Draft should order these units to make rectification within a specified time limit; otherwise, a fine in an amount of between one thousand and ten thousand yuan shall be imposed.
It is worth mentioning that the Draft stipulates that it is prohibited to release tobacco advertisement in public places and other public areas classified by the local people’s governments above the county level or to releasing tobacco advertisements via news media in order to keep a rein in advertising of tobacco. Moreover, tobacco vending machines is prohibited to be set.
