Woman Sues Noodle Shop ¥1,000 for Finding Hair

A woman from Ningbo in Zhejiang Province recently won a month-long legal battle with a noodle shop, after finding a hair in her meal.

2 July 2018, the woman claimed that, after finding a hair in her noodles, she called over the waiter who initially ignored her complaint.

The woman asked to see the manager or boss, at which the waiter “smirked” and replied, “No”, because neither were present. They continued to ignore the woman.

Enraged, the woman took photos of the shop, food and presumably the hair and called China’s complaints hotline, 12315. After 4 days of attempted negotiations, the boss refused to compensate her and dared the woman to take it to court.

The woman later opened the case at the Haishu District Court in Ningbo, insisting “that it [her case] be implemented in accordance with Article 148 of the Food Safety Law of the People’s Republic of China, and refunded a total of ¥1,016”, reported Zhejiang Daily.

The article is called the “guarantee clause” of the Food Safety Law; Anyone who encounters food quality problems will start with a compensation of 1,000 yuan.

On 15 August, the woman was paid on the spot ¥1,016 in compensation by the shop owner, who also thanked the woman for helping his business grow.
